• You acknowledge and agree that the participation in the GIGABYTE "Beat Me If You Dare" Global Online Graphics Overclocking Competition (hereinafter "Competition") is subject to the terms and conditions described herein. By submitting your entry to the Competition, you hereby express your consent and agree to be bound by these Rules. GIGABYTE Technology reserves the right to disqualify any entry if it has reasonable grounds to believe the participant has breached any of these Rules.
• Competition is organized by GIGABYTE Technology and all Rules, jury and winner nomination remain at the sole discretion of GIGABYTE Technology. GIGABYTE Technology reserves the right not to award any Competition entry when appropriate. GIGABYTE Technology also reserves the right to change or amend the Rules, to postpone the Competition, to interrupt it or to cancel the Competition at any time without prior notice and without any compensation to any participant. • By entering the Competition, you hereby guarantee that all information submitted by you is true, current and complete.
• You hereby agree that the information submitted by you may be used for further marketing purposes of GIGABYTE Technology or any of its partners, subject to GIGABYTE Technology privacy policy.
• By submitting an entry to the Competition you hereby agree to transfer and assign to GIGABYTE Technology all copyrights and other rights regarding the competition entry without any further compensation or fees. All possible content and substance of the entry submitted by you will become the sole property of GIGABYTE Technology and may be used by GIGABYTE Technology or any other party without any link to the participant.
• You hereby agree that GIGABYTE Technology may publish, at their sole discretion, any entry submitted to the Competition on web sites and other presentation materials of GIGABYTE Technology or its partner network.

Run order:

1. October GTX 260 (3DMark Vantage P) + Resident Evil 5 game benchmark
2. November GTX 275 (3DMark Vantage P) + Resident Evil 5 game benchmark
3. December GTX 275 SLI (3DMark Vantage P) + Resident Evil 5 game benchmark

Qualifications:

• Join as a member on the "Beat Me If You Dare" microsite.
• Contestants must use graphics cards with appointed chip set. There is no brand limitation.
• Competition entry period is October 1 through December 31 2009.
• Persons employed by or in a similar relation to GIGABYTE Technology, their subsidiaries or to companies participating on the preparation and organization of the whole Competition as well as members of their families, are nonetheless excluded from participation.
• Competition entries must conform to the Competition instructions. GIGABYTE Technology shall evaluate only such entries that fulfill all criteria described by GIGABYTE Technology. No inaccuracies in form or format can be accepted and will not be tolerated.
• By participating in the Competition you hereby guarantee, that you have created the entry by yourself and that it was not for payment or in any other way put at the disposal of a third person, to which your rights have been granted or transferred.
• You hereby guarantee and are liable to ensure that the entry will not infringe any copyright, trade secret, other proprietary right or privacy of any third party and will not contain anything which is libelous, defamatory, obscene, indecent, harassing or threatening. Any unauthorized use of any copyrighted material is strictly prohibited and will lead to disqualification of such participant without notice. GIGABYTE Technology shall not be responsible of any infringements of any intellectual property rights.

According to the information from branch office and media all over the world, there is a graphics manufacture supporting overclockers with special graphics cards which could not be purchased in the market to attend this competition, in order to beat GIGABYTE.

In order to maintain the fairness of this OC event for all attendees, GIGABYTE announces a new rule as below:

• Qualifications: Contestants must use GIGABYTE graphics cards with appointed chip set.

Online submissions:

• 3DMark Vantage:

1. Use Performance settings for 3DMark Vantage
2. Have a valid screenshot: clearly show 3Dmark score, 3Dmark subtest scores, 3Dmark settings, processor in CPU-Z, videocard in GPU-Z (GPU-Z in screenshot, dropdown must be visible if you run in SLI so all videocards are identified. Rivatuner may be used if GPU-Z fails to identify videocard properly)
3. final result screenshot must be uploaded in BMP file format

4. Have a valid Futuremark orb link as verification for scores. Link should begin with http://service.futuremark.com/compare?3dmv=. (Check 3D Mark FAQ for how to publish your system score: http://www.futuremark.com/support/orb )

• Resident Evil 5 game benchmark:

1. Use Resident Evil 5 DirectX 10 version

2. Use Variable Benchmark scene presetting with 1280x1024 display resolution

3. Have a valid screenshot: clearly show fps score, processor in CPU-Z, videocard in GPU-Z (GPU-Z in screenshot, dropdown must be visible if you run in SLI so all videocards are identified. Rivatuner may be used if GPU-Z fails to identify videocard properly)

Please upload as ONE .bmp file. Example as below:

• Contestants must upload one picture of the actual platform to show that the components are clearly marked
• Each participant may submit multiple scores to the Competition, but only the most recent score will be accepted
• Submitting the same score to multiple accounts is prohibited. Any contestant that breaks this rule will be disqualified.

Rules:

• No liquid Helium.
• Accept launched CPU, including engineering sample and retail kit, but Gulftown (Core i9) is disallowed.

• No cheating. GIGABYTE will not allow people to cheat their way to higher scores and disadvantage those who play fair. We try to be as clear and strict as possible when it comes to cheaters, and block the score instantly. Depending on the method used and the motivation behind the cheating, we will also ban the individual from future competitions.

• Instant ban if it is considered as severe cheating

- Submitting scores that belong to other people
- Using software or human interaction altering the perceived speed of the benchmark program, tricking it to believe it ran faster
- Using a program to edit screenshots to have more points

• Forbidden tweaks

- PhysX drivers
- Mipmap tweaking
- Any software or human interaction altering the perceived speed of the benchmark program, tricking it to believe it ran faster
- Wireframe hacks: any software or driver causing a benchmark program not (properly) render the textures
- Rendered image differs too much from the original due to other software tweaking

• No LOD Bias adjustment and LOD must be set to 0. Accept 3DMark Vantage presets of performance; not allow changing system registry or adjusting LOD Bias. If your 3DMark sub-test score 2 exceeds sub-test score 1, the contester must provide your overclocking video for approval and confirmation.
• Prizes provided for first, second and third place for top 3 overall final score winner. If you beat our in-house overclocked score, GIGABYTE will DOUBLE the prize!

• Scoring method:

1. (contestant's 3DMark Vantage Performance GPU score - 9000) / 9000 = X1 %
2. (contestant's game benchmark fps score - 100) / 100 = X2 %
3. X₁ *80% + X₂ *20% = final score

• Note: 3DMark Vantage (Performance) GPU score 9000 and Resident Evil 5 benchmark 100 result from GIGABYTE official platform, using standard GTX 260 graphics card.

Results

Results for each test must be submitted by the end of each month with no exceptions allowed.

Time zone is the International Time/Date Line: so GMT +8 hours.

Prizes:

• GIGABYTE will judge the winners based on the ranking of attendees' final score after submitting deadline.
• GIGABYTE will keep a running real time score of the top 3 members on this microsite, but only the final top 3 overclockers will win prizes.
• GIGABYTE will announce the final 3 winners as well as 5 lucky draw winners on the 5th day of every month during the "Beat Me If You Dare" online OC competition, and may contain the name, surname, town and state of the winner.
• Please check awards for winners in award page.
• Winners of the Competition will be notified by e-mail. Return of any prize notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and selection of an alternate winner.
• The winner shall be deemed waiving his/her rights to the prize if the winner fails to claim the prize within 1 month from the day the list of winners is announced or if the winner fails to comply with the required procedures
• GIGABYTE is responsible for the expense of delivering the prize, but the winner is responsible for any tariffs or additional taxes, which are stipulated by tax-laws of Taiwan, related to the prize.

Winner Selection: Top 3 winners announcing and a random drawing for 5 lucky attendees will take place on 5th day of every month during the "Beat Me If You Dare" online OC competition with all the eligible entries received. The drawing will be conducted by GIGABYTE. The decisions of GIGABYTE are final and binding in all matters relating to this competition. The potential winner/s will be notified by GIGABYTE by email and posted onto the competition's website. If such notification is undeliverable or no response is received by GIGABYTE from the potential prize winner within ten (10) business days of the date of notification or attempted notification, then such potential prize winner will be disqualified, and an alternate winner may be selected at GIGABYTE's sole discretion. Potential prize winner's failure to return all required forms within 1 month may result in the potential prize winner being disqualified and an alternate winner may be selected at GIGABYTE's sole discretion.

Privacy: All information collected by GIGABYTE in connection with the entries will remain confidential. GIGABYTE may at times send promotional news to you in the future.

Agreement: GIGABYTE reserves the right to cancel or suspend this competition should viruses, bugs or other causes beyond their control corrupt the administration, security or proper play of the competition. GIGABYTE further reserves the right to modify the rules of the competition in any way or at any time, as long as reasonable notice is given.
